The County of Del Norte District Attorney's Office is seeking a qualified candidate to fill two (2) vacancies for the position of Deputy District Attorney I/II/III. These positions are classified as full-time.
These positions are a series in a classification of Deputy District Attorney performing professional legal work relative to prosecution of criminal offenders including violations of family support law, that requires legal knowledge, skills and abilities to perform a variety of tasks associated with prosecution. These classifications are Professional for benefit purposes and are exempt from the overtime provisions of the FLSA.
Under general to indirect supervision performs assigned legal work necessary for successful prosecution of cases depending upon experience, proficiency and the complexity and sensitivity of cases. Incumbents may direct or assist with the prosecution of cases from pretrial through appeal stages.
Deputy District Attorney I is the first working level in this professional class and is assigned duties relative to prosecution which may be routine to complex with a high level of responsibility for case outcome. The entry level is assigned duties that will increase experience and expertise. With additional experience and abilities incumbents may be eligible for advancement in this series.
Deputy District Attorney II is the second level and is assigned the more complex cases and tasks under minimal supervision. Incumbents advanced to this level in the series have demonstrated the ability and skills to adequately fulfill the requirements for this level through experience.
Deputy District Attorney III is the most experienced level and is assigned the complex and technical cases and tasks and is capable of working independently in any number of complex areas without direct supervision except, as new or unusual circumstances require. This level may supervise other Deputy District Attorneys in a lead person capacity.
Detailed Work Activities
Essential job duties may include any of the following tasks, knowledge, skills and other characteristics. The list that follows is not intended as a comprehensive list; it is intended to provide a representative summary of the major duties and responsibilities. Incumbent(s) may not be required to perform all duties listed, and may be required to perform additional, position-specific tasks.
Evaluates, develops and prepares, files and presents the prosecution’s case in all phases of criminal cases referred to the District Attorney Office for processing.
Reviews and analyzes evidence that includes interviewing witnesses and victims of criminal activities that may include family support issues, crime and investigation reports and other materials related to pending cases; obtains search warrants and subpoenas as necessary.
Reviews, analyzes and researches allegations to make a determination as to appropriate charges following receipt of agency reports, filing criminal charges and keeping victims and witnesses informed of the status of legal proceedings relative to their involvement in the case.
Makes appropriate recommendations regarding sentencing and presents the County’s position at sentencing and revocation hearing.
Negotiates with defense attorneys at pretrial hearings regarding case disposition or modifications.
Assists and advises investigators and other law enforcement agencies regarding investigations in progress.
Researches law and precedents to obtain information needed to prosecute pending cases and to complete special assignments.
Interprets and stays abreast of current litigation and changes in law and maintains current knowledge of changing case law.
Performs appellate research and drafts appellate briefs and appears in the designated court of appeal when necessary.
Assists in training and/or supervision of staff as assigned.
May provide legal advice and expertise for the Family Support Division.
Performs related duties as required and/or directed.
Selection Process:

Condition of Employment:

Disaster Service Workers: All County of Del Norte employees are designated Disaster Service Workers through State law (California Government Code Section 3100-3109). Employment with the County of Del Norte requires the affirmation of a loyalty oath to this effect. Requirements
Minimum Qualifications
Level I:
Graduation from a college or university with an appropriate law degree AND membership in the California State Bar Association with an active license to practice law.
Level II:
Graduation from a college or university with an appropriate law degree and membership in the California State Bar Association with an active license to practice law
One (1) year experience as a criminal prosecution or defense attorney in the State of California and the demonstrated knowledge and ability to successfully perform the duties.
Level III:
A minimum of three (3) years' experience as a criminal prosecution or defense attorney in the State of California and membership in the California State Bar Association with an active license to practice law
The demonstrated ability to work independently and to train and oversee the work of others in a lead person capacity.
Knowledge, Skills and Abilities
Knowledge of:
California statutes and their application to criminal law, that may include family support issues.
Principles and practices of criminal, constitutional and administrative law.
Principles, methods and techniques of legal research and investigations.
Judicial procedures and rules of evidence, including laws of search and seizure.
Appropriate software applications relative to the necessary duties.
Ability to:
Develop legal issues and present clear and logical arguments and statements of fact and law.
Define issues, perform legal research, analyze problems, evaluate alternatives and make appropriate recommendations.
Present statements of fact, law and arguments clearly and logically while exercising sound independent judgment within the general policy guidelines and legal parameters.
Effectively represent the District Attorney Office in contacts with the public, community organizations, other law enforcement agencies and other governmental jurisdictions.
Establish and maintain a cooperative teamwork relationship with staff of the District Attorney’s office, other departments and justice organizations, fellow attorneys and the general public.
Operate a keyboard/typewriter and office equipment is required.
